
Small Business Health Insurance Plans in Nevada-
Small Group (2-99 employees) are offered several types of
Health Insurance Plans in Nevada. Federal law mandates that no matter what pre-existing conditions exist in an individual/employee, no small group member may be turned down (or denied) health insurance coverage thru a "Group Sponsored" plan. This requirement is known to the Insurance Industry as a "Guaranteed Issue" plan.
All small group plans (small businesses and the Self Employed) can renew it's Health Insurance plan contract every year (at the Employer's discretion) unless there are issues such as fraud, non-payment of premiums, falsifying documents, or intentional misrepresentation (or there was some failures on the part of the Employer in accordiance with the rules of the plans). There is normally a "review period" where the Health Insurance Carrier will look thru the census of each group and determine what "conditions" apply to the group and try to adjust plans/premiums in accordiance to the facts gathered in that "group census."
Small group and the Self Employed Insurance Carriers are required to allow any pre-existing conditions as long they were covered undered "credible coverage" with another Insurer within 63 days of enrollment period. If an Insurance Carrier is unable to obtain information deemed "necessary" to accurately determine the risk of an applicant, it will "underwrite" more conservitavely (which means that the assumption of the risk will be cast in a negative light when determining premium rates.
COBRA continuation benefits-
If your employer group is larger than 20, you are entitled to continuation coverage by the Consolidated Omnibus Budget Reconciliation Act (COBRA). Nevada businesses may be required to offer you continuated coverage for up to 18 months based on how the seperation of employee from business happened (example: did you quit/resign your employment or was employment terminated by employer?).
